The court has received Defendant Myriad Group A.G.’s (“Myriad”) motion to strike and

16

request for sanctions and the parties’ related briefing. [Docket Nos. 142, 151, 159, 161, 163.] The

17

court orders the parties to submit supplemental evidence in connection with the motion by June 18,

18

2014, as follows: pursuant to ADR Local Rule 7-5(b)(3), each party shall file a declaration(s) with

19

any supporting evidence to support its claim regarding whether the parties’ discussions outside the

20

presence of Magistrate Judge Cousins were part of the court-ordered settlement conference process.

21

Plaintiff Oracle America, Inc. shall also file a declaration(s) with any supporting evidence setting

22

forth the actions it took to obtain independent evidence of the alleged wrongdoing by Myriad that it

23

asserts that Myriad disclosed in the course of the parties’ settlement discussions, and the results of

24

those efforts. The parties’ June 18, 2014 submissions shall be filed under seal.
