within seven days, proof that he served Defendant Secretary of

Transportation Ray LaHood in accordance with Federal Rule of Civil

Procedure 4.

to prosecute.

Accordingly, Plaintiff’s claims against Secretary LaHood are

dismissed without prejudice for failure to prosecute.
