Plaintiff and Counterclaim Defendant Solannex, Inc. (“Solannex”) and Defendant and

Counterclaimant Nanosolar, Inc. (“Nanosolar”) (collectively the “Parties”) have reached a settlement

19

in principle in the above entitled matter. The Parties anticipate that written confirmation of the

20

settlement agreement shall be completed and signed by the parties by May 1, 2012. Once the

21

settlement agreement has been executed, the Parties will file a Stipulation and Order for Dismissal,

22

dismissing Solannex’s Second Amended Complaint and Nanosolar’s Counterclaim pursuant to

23

Federal Rule of Civil Procedure 41. The Parties respectfully request a deadline of May 4, 2012 to

24

file the Stipulation and Order for Dismissal.

25

In addition, the Parties respectfully request the Court to stay all proceedings pending the

26

filing of all necessary dismissal documents. In the event that the terms and conditions of the

27

settlement are not fulfilled, the Parties shall notify the Court and request that the scheduled deadlines

28

and dates be reset.
