Pursuant to Civil Local Rule 7-7, Plaintiffs hereby move the Court for an order continuing
the hearing on Defendants’ motion to dismiss. Good cause appears for this motion as follows.

Plaintiffs’ attorney is a sole practitioner who works outside of the San Francisco Bay Area
19
each Monday at an office in northern Monterey County. The Court has scheduled the hearing on
20
Defendants’ motion to dismiss for Monday, October 31, 2011. Plaintiffs’ counsel is unavailable to
21
appear on that date.

The parties’ counsel have conferred. Defendants’ counsel Kimberly E. Wiggans has
23
informed Plaintiffs’ counsel that Defendants do not oppose a continuance of the hearing on
24
Defendants’ motion to dismiss to Tuesday, February 28, 2012 at 1:00 p.m.
