The parties in the above referenced action hereby stipulate as follows:

Whereas Plaintiff filed this action in the San Jose Division of the Northern District of

California on April 8, 2011 in pro per.
Whereas on July 19, 2011, this action was transferred to the Oakland Division of the
-1Stipulated Request for Continuance of CMC and [Proposed] Order Thereon

Northern District of California, and assigned to Judge Armstrong.

Whereas on August 9, 2011, Judge Armstrong issued a Case Management Order setting a
telephonic Case Management Conference for October 19, 2011.

Whereas on September 23, 2011, attorney Anne-Leith Matlock filed a notice of
appearance in this action as counsel for Plaintiff.

Whereas counsel for the parties met and conferred by telephone on September 27 and
October 5, 2011;

Whereas Plaintiff agreed to file an Amended Complaint by October 28, 2011;

Whereas Defendant agreed to file a Responsive Pleading by November 18, 2011;
