Defendant West Coast Children’s Clinic requests that the

Court enter judgment as to the claims against it by Plaintiffs

Ronald J., Nora J. and Noah J., by and through their guardian ad
16
litem, Curtis R. Namba.

the Court dismissed Plaintiffs’ claims against it and that
18
Plaintiffs did not amend their complaint to re-assert the claims
19
against it within the time period permitted by the Court.

In support thereof, Defendant states that
Federal Rule of Civil Procedure 54 provides in part, “When an
21
action presents more than one claim for relief . . . or when
22
multiple parties are involved, the court may direct entry of a
23
final judgment as to one or more, but fewer than all, claims or
24
parties only if the court expressly determines that there is no
25
just reason for delay.”
Fed. R. Civ. P. 54(b).

Defendant has not demonstrated that there is no just reason
27
to delay entry of final judgment against it until such time that
28
the Court can enter a judgment adjudicating all the claims and all

the parties’ rights and liabilities.

DENIES Defendant’s request for entry of partial judgment (Docket
3
No. 32).
