Pursuant to Civil 16 Local Rule 7-3, any brief in opposition to Plaintiff’s motion was due on March 23, 2012, but 17 Defendant filed neither an opposition nor a statement of nonopposition to the motion as required by 18 Civil Local Rule 7-3(b). Defendant Abitsch & Abitsch is hereby ordered to show cause for its 19 failure to file an opposition to the motion to dismiss or, alternatively, to file a statement of 20 nonopposition in accordance with Civil Local Rule 7-3(a) and (b). Defendant Abitsch & Abitsch 21 must file its response to this order to show cause, or file its notice of nonopposition to the motion to 22 dismiss, by no later than April 12, 2012. This order to show cause does not constitute permission to 23 file a late opposition. Defendant's failure to respond to the order to show cause may result in 24 dismissal of portions of Abitsch & Abitsch’s counterclaim. 25 26 IT IS SO ORDERED. Dated: April 5, 2012 27 28 DONNA M.
