The Court heard argument on Defendants’ Motion to Compel Arbitration on February 28,
17

23
an exception to the enforceability of an arbitration agreement in section 2 of the Federal Arbitration

Act exists where an agreement would require employees to waive their right to class litigation or
25
arbitration, because such an agreement would be illegal and unenforceable under federal labor law,
26
including the National Labor Relations Act, 29 U.S.C. §157, and the Norris-LaGuardia Act, 29
27
U.S.C. §101 et seq.
