Defendant seeks leave to depose Plaintiff, and requests a second extension of
17

time in which to file a dispositive motion. Having read and considered Defendant’s
18

requests and the accompanying declaration of counsel, and good cause appearing,
19

IT IS HEREBY ORDERED that Defendant’s motion seeking leave to depose

20

Plaintiff (Dkt. 28) is DENIED as moot because leave to do so has previously been
21

granted in the Court’s May 7, 2014 Order. See Dkt. 13 at 6.

22

IT IS FURTHER ORDERED that Defendant’s request for a second extension
23

of time (Dkt. 29) is GRANTED. The time in which Defendant may file a
24

dispositive motion will be extended up to and including December 29, 2014.
25

Plaintiff’s opposition to the dispositive motion shall be filed with the Court and
26

served on Defendant no later than twenty-eight (28) days after the date Defendant’s

27

motion is filed. Defendant shall file a reply brief no later than fourteen (14) days
28

after the date Plaintiff’s opposition is filed.

No further extensions will be granted absent exigent circumstances.

3

This Order terminates Docket Nos. 28 and 29.
