MOTOROLA, INC.; QUALCOMM, INC.; FREESCALE SEMICONDUCTOR, INC.; and ATI TECHNOLOGIES, ULC, Defendants. ________________________________/ AND ALL RELATED COUNTERCLAIMS / Defendants ATI Technologies ULC, Freescale Semiconductor, 13 Inc. and Qualcomm, Inc. object to the Special Master’s Report and 14 Recommendation (Docket No. 1026 in Case No. 05-4063) regarding 15 their motions to strike Plaintiff Tessera, Inc.’s Amended 16 Disclosure of Infringement Contentions. 17 Docket No. 200. Pursuant to the Amended Order of Reference to the Special 18 Master, Defendants were required to submit with their objection 19 any record necessary for the Court to review the Special Master’s 20 Report and Recommendation. 21 motions to strike filed by Freescale and Qualcomm have been filed 22 in the docket, see Docket Nos. 155 and 175, Defendants have not 23 provided the Court with the complete briefing that was submitted 24 to the Special Master. Docket No. 138 ¶ 6.3. Although the 25 Accordingly, within three Court days of the date of this 26 Order, Defendants shall provide the Court with chambers copies of 27 all documents that any party submitted to the Special Master in 28 connection with these motions, except those already filed in the 1 docket of this action. 2 these documents in the docket or shall file a motion for leave to 3 file the documents under seal, and shall file a declaration 4 attesting that they have provided the Court with all documents 5 required by this Order. 6 7 8 By that date, Defendants shall also file Defendants’ failure to comply with the requirements of this Order will result in their objections being overruled.
