PACIFIC BELL TELEPHONE COMPANY, doing business as AT&T, Defendant. ________________________________/ On August 10, 2012, the Court granted Defendant Pacific Bell 15 Telephone Company’s motion to stay the case pending the resolution 16 of the Pacific Bell Wage and Hour Cases, Alameda County Superior 17 Court, Case No. JCCP004637. 18 statute of limitations for putative collective action members from 19 the date on which Plaintiff Frank Koval filed this federal action 20 through the date on which the stay is lifted, provided that Koval 21 promptly moved to add his FLSA claim to the state court complaint. 22 On October 12, 2012, Plaintiff filed a notice informing the Court 23 that the Alameda County court granted his motion to add the FLSA 24 claim to the state court action. 25 The Court equitably tolled the FLSA On November 10, 2014, the Court ordered the parties to file a 26 status report regarding the status of the state court litigation. 27 The parties have filed a joint request that the Court dismiss the 28 instant case, stating that it is a “duplicative parallel action.” 1 Accordingly, the Court dismisses this action. 2 Court shall close the case. 3 IT IS SO ORDERED.
