1 IN THE UNITED STATES DISTRICT COURT 2 FOR THE NORTHERN DISTRICT OF CALIFORNIA 3 4 SPRINT NEXTEL CORP., 5 Plaintiff, 6 ORDER DIRECTING PLAINTIFF TO SUBMIT SUPPLEMENTAL MATERIALS RE: SANCTIONS v. 7 THUC NGO d/b/a TONY BUY IPHONE, 8 Defendant. ________________________________/ 9 10 United States District Court For the Northern District of California No. C 12-2764 CW On March 18, 2013, Plaintiff Sprint Nextel Corporation moved 11 for an order to show cause why Defendant Thuc Ngo should not be 12 held in civil and criminal contempt. 13 requested that the Court impose various compensatory and punitive 14 sanctions upon Defendant for violating the October 9, 2012 15 injunction. 16 The Court therefore allows Plaintiff to submit supplemental 17 documentation to support its request for sanctions. 18 In its motion, Plaintiff Plaintiff's showing is deficient in several ways. Specifically, Plaintiff shall submit: (1) an itemized billing 19 statement to support its request for attorneys’ fees and costs; 20 (2) an itemized billing statement to justify its request for 21 investigative costs; (3) sworn evidence, from a person with 22 personal knowledge, documenting how many Sprint cellphones 23 Defendant has purchased since the injunction issued and explaining 24 how it calculated its claimed damages.1 25 shall submit a supplemental brief, not to exceed two pages, In addition, Plaintiff 26 27 28 1 The declarations Plaintiff previously submitted do not provide sufficient details for the Court to determine whether Plaintiff’s request for compensatory sanctions is reasonable or accurate. 1 describing in greater detail the nature of the coercive sanctions 2 it seeks and explaining how and why such sanctions should be 3 imposed. 4 All of these materials must be filed by May 23, 2013.
