WHEREAS a case management conference for the three related captioned actions and the
hearing of the parties' cross-motions for summary judgment are set for November 7, 2013;
WHEREAS a joint mediation of the three related captioned actions and the related action
4
captioned Federal Deposit Insurance Corporation v. Hong et al., Case No. C 12-2658 CW, is
5
scheduled to take place on November 5, 2013, before the Hon. James L. Warren (Ret.) at the San
6
Francisco office of JAMS; and
7
WHEREAS, the outcome of that mediation and any additional settlement negotiations that
8
follow may obviate the need for a case management conference and the hearing of the cross-
9
motion for summary judgment;
10
IT IS HEREBY STIPULATED by and between the parties through their designated
11
counsel that the case management conference and the hearing of the cross-motions for summary
12
judgment in the captioned actions currently scheduled for November 7, 2013, be continued to
13
November 21, 2013, or other date suitable for the Court, and that the parties must submit a Joint
14
Case Management Statement or individual Case Management Statements at least seven days
15
before that date.
