Plaintiff has filed a pro se civil rights action pursuant to 42 U.S.C. § 1983. He has not paid

16

the filing fee or filed a motion for leave to proceed in forma pauperis ("IFP"). Even though he has

17

not filed an IFP application, he submitted his Certificate of Funds and prison trust account statement.

18

The acts complained of occurred at the R. J. Donovan Correctional Facility, which is located

19

in the Southern District of California, and it appears that Defendant resides in that district. Venue,

20

therefore, properly lies in that district and not in this one. See 28 U.S.C. § 1391(b).

21

Accordingly, in the interest of justice and pursuant to 28 U.S.C. § 1406(a), this action is

22

TRANSFERRED to the United States District Court for the Southern District of California. The

23

Clerk of the Court shall transfer the case forthwith.
