The above-captioned action be dismissed without prejudice as to Joseph A. Ovick
and Lynn Mackey; and,

Plaintiffs may amend their Complaint to include the Contra Costa County Office
of Education as a defendant to Plaintiffs’ Americans with Disabilities Act cause of action.
