On January 31, 2014, plaintiff filed a notice of motion to dismiss, seeking dismissal

of the case, without prejudice, based on plaintiff’s inability to serve defendant with the
15
summons and complaint. Plaintiff noticed a hearing date of March 12, 2014, but the court
16
finds the motion suitable for disposition without a hearing, and hereby DISMISSES the
17
action without prejudice, and VACATES the March 12, 2014 hearing date.
