1 UNITED STATES DISTRICT COURT 2 FOR THE NORTHERN DISTRICT OF CALIFORNIA 3 OAKLAND DIVISION 4 5 ILLUMINATION DYNAMICS CO., LTD., a Case No: C 14-0078 SBA foreign company, 6 Plaintiff, 7 ORDER REFERRING ACTION FOR FURTHER SETTLEMENT CONFERENCE vs. 8 PACIFIC LIGHTING SOLUTIONS L.L.C., 9 and BILL ZHANG, an invidual, Defendants. 10 11 12 The parties previously reached a settlement at the Mandatory Settlement Conference 13 conducted by Magistrate Judge Elizabeth Laporte. Dkt. 104. A dispute between the parties 14 has since arisen regarding Defendants’ performance with the terms of the settlement. As a 15 result, Plaintiff has filed a motion to enforce the settlement agreement, or alternatively, to 16 reopen the action and set a trial date. Dkt. 110. 17 Before investing any further resources in litigating this matter, the parties shall 18 endeavor to resolve their present dispute without the need for formal, judicial intervention. 19 Accordingly, 20 IT IS HEREBY ORDERED THAT the instant action is REFERRED to Magistrate 21 Judge Elizabeth Laporte for a further settlement conference or such other settlement-related 22 proceeding as she deems appropriate. Plaintiff’s motion to enforce the settlement 23 agreement shall be held in ABEYANCE pending further order of the Court. In the event 24 the parties resolve their apparent disagreement regarding the settlement, Plaintiff shall file a 25 withdrawal of their motion. 26 27 28 IT IS SO ORDERED.
