ORDER OF DISMISSAL CALIFORNIA PHYSICIANS’ SERVICE, 11 For the Northern District of California United States District Court 10 No. C 14-1892 PJH Defendant. _______________________________/ 12 13 The parties hereto, by their counsel, having advised the court that they have agreed 14 to a settlement of this case, IT IS HEREBY ORDERED that this action is dismissed 15 without prejudice; provided, however that if any party hereto shall certify to this court, 16 within sixty (60) days, with proof of service on the opposing party thereof, that the agreed 17 consideration for said settlement has not been delivered over, the foregoing order shall 18 stand vacated and this action shall forthwith be restored to the calendar to be set for trial. 19 If no certification is filed, after passage of sixty (60) days, the dismissal shall be with 20 prejudice. The parties may substitute a dismissal with prejudice at any time during this 21 sixty-day period. 22 23 24 25 26 27 28 IT IS SO ORDERED.
