Sky Courier Inc. dba DHL Same Day (“Defendant,” collectively “the Parties”), by and through

their respective undersigned counsel, that the above-captioned action be and hereby is dismissed

with prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii). This dismissal is

intended to be effective even “without a court order.” Fed. R. Civ. P. 41(a)(1)(A).
Pursuant to the terms of the Settlement Agreement entered into between the Parties, each
