Nos. 115, 116 Defendants. 8 9 Plaintiff filed its Second Amended Complaint on May 24, 2016. (Dkt. No. 114.) On June 13, 2016, Defendants filed a request for a summary judgment pre-filing conference as well as an 11 United States District Court Northern District of California 10 Administrative Motion for Extension of Time to File a response to the Second Amended 12 Complaint. (Dkt. Nos. 115, 116.) 13 The Court DENIES the request for a summary judgment pre-filing conference. Defendants 14 have offered no legal authority or argument suggesting that permitting them to file a motion under 15 Rule 56 at this juncture in this case—prior to any responsive pleading, a Rule 16 scheduling 16 conference, and an opportunity for discovery—would be appropriate. 17 Defendants’ Motion for Extension of Time to File a response the Second Amended 18 Complaint is GRANTED IN PART.
