2 PURSUANT TO FEDERAL RULE OF CIVIL PROCEDURE RULE 58 THAT:

The settlement of Guttmann v. Ole Mexican Foods, Inc., Case No. 3:14-cv-04845-HSG,

4 pending in the United States District Court, Northern District of California (the “Litigation”), on the

5 terms set forth in the Parties’ Settlement Agreement, with exhibits, and definitions included therein,

6 dated June 29, 2015, and filed with this Court on July 2, 2015, Doc. 48-2, was finally approved by order

7 of this Court dated August 1, 2016.

Pursuant to Rule 58 of the Federal Rules of Civil Procedure (“Rule 58”), the Court

9 hereby approves the form of judgment and sets forth the judgment in this separate document, to be

10 entered into the civil docket, pursuant to Rule 79(a).

The claims in this Litigation are dismissed on the merits and with prejudice pursuant to

12 the terms set forth in the Parties’ Settlement Agreement and in the Court’s Final Order Approving Class

13 Action Settlement.

4.

The Court will retain continuing jurisdiction over the Parties and the Litigation for the

15 reasons and purposes set forth in the Final Order Approving Class Action Settlement, without affecting

16 the finality of this Final Judgment.
