Pursuant to the Civil Local Rules of the United States District Court for the Northern
2 District of California, the parties, Plaintiffs BRETT MACDONALD and AMALIA
3 MACDONALD (“Plaintiffs”), and Defendant WELLS FARGO BANK, N.A. (“Wells Fargo”),
4 through their counsel of record, hereby stipulate to the following:

RECITALS
6
1.
WHEREAS, on September 21, 2017, this Court set this matter for trial for May 1,
7 2017 and set a pretrial conference for April 18, 2017;
8
2.
WHEREAS, pursuant to this Court’s Civil Pretrial and Trial Standing Order, the
9 Parties Pretrial Filings and any oppositions to the Motions in Limine filed in this matter are due no
10 later than April 4, 2017;
11
3.
WHEREAS, on March 29, 2017, this Court referred this matter to Judge Joseph C.
12 Spero for a Settlement Conference;
13
4.
WHEREAS, on March 29, 2017, Judge Joseph C. Spero set this matter for a
14 Settlement Conference to occur on April 4, 2017;
15
5.
WHEREAS, on March 31, 2017, pursuant to the parties’ stipulation, the Court
16 continued the deadline for Pretrial Filings and Oppositions to Motions in Limine to April 11,
17 2017;
18
6.
WHEREAS on April 4, 2017, the parties reached agreement in principle on
19 settlement at the Settlement Conference, subject to additional prerequisite steps and analysis that
20 must be undertaken by the parties; and
21
7.
WHEREAS, in an effort to keep costs in this litigation down and to facilitate
22 anticipated settlement of this matter, the Parties request that the deadline for the Pretrial Filings
23 and Oppositions to Motions in Limine be extended to April 17, 2017 to allow the parties to focus
24 on resolution of the matter prior to the April 18, 2017 Pretrial Conference.
