No. C 16-01225 JSW ORDER VACATING HEARING ON MOTION FOR RECONSIDERATION AND DENYING MOTION TO STAY PENDING RULE 23(f) PETITION / 20 21 Pursuant to Civil Local Rule 7-1(b), the Court finds that Defendants’ motion for 22 reconsideration of the Court’s order granting class certification, which has been noticed for hearing 23 on Friday, February 9, 2018 at 9:00 a.m., is appropriate for decision without oral argument. The 24 hearing date for the motion is hereby VACATED. The motion for reconsideration will be taken 25 under submission and decided on the papers. 26 The Court has considered Defendants’ motion to stay the Court’s order granting class 27 certification pending resolution of Defendants’ Rule 23(f) petition seeking permission to appeal the 28 order to the Ninth Circuit Court of Appeals. Having received notice of the Ninth Circuit’s denial of 1 the petition dated January 23, 2018, the Court DENIES Defendants’ motion to stay pending appeal 2 as moot. 3 4 IT IS SO ORDERED.
