There may be a need in this case for an evidentiary hearing to determine the threshold issue

of whether Plaintiff is entitled to equitable relief for certain untimely or unexhausted claims. The
15
Court intends to resolve these issues in a bench trial that would take place before the case is
16
submitted to a jury for a decision on the merits.
Accordingly, the parties are DIRECTED to meet and confer and submit a joint statement
17

informing the Court as to whether they are available for a two-day bench trial on any of the
19
following dates:

April 30, 2018 - May 1, 2018

May 1-2, 2018
22
June 19-20, 2018
23
June 20-21, 2018
24
June 21-22, 2018
25
Trial would take place between 8:30 a.m. and 1:30 p.m., with the exception of June 22, where trial
26
would begin in the early afternoon.
