WHEREAS, Plaintiff/Counterdefendant Mysfyt, Inc. (“Plaintiff” and “Mysfyt”) and

Defendant/Counterclaimant James Lum (“Defendant” and “Lum”) (collectively the “Parties”) have

reached an agreement in principle for a settlement of this action;

25

WHEREAS, the Parties are in the process of finalizing a written settlement agreement;

26

WHEREAS, the Parties anticipate the process to finalize settlement will be completed

27

within thirty (30) days;

WHEREAS, a Further Case Management Conference is scheduled to take place on April 11,
2017 at 1:30pm, with a Further Case Management Statement due April 4, 2017.
NOW THEREFORE, IT IS HEREBY STIPULATED AND AGREED by and among the

Parties, through their undersigned counsel, that the action be stayed for a period of 30 days pending

5

the finalization of the settlement agreement, and that the Further Case Management Conference

6

scheduled on the Court’s April 11, 2017 calendar be moved to May 23, 2017 with the Further Case

7

Management Statement to be filed by May 16, 2017.
