The parties in the above captioned matter hereby stipulate by and through their

undersigned counsel of record as follows:

WHEREAS Plaintiff S.S., a minor, by and through her guardians ad litem, JILL and
4
KRISS SULKA, and Defendant OAKLAND UNIFIED SCHOOL DISTRICT (collectively
5
hereinafter “PARTIES”) reached a settlement agreement which embodies the PARTIES
6
agreement and waiver and release of claims;
7
WHEREAS, the settlement agreement resolves the matter in its entirety; and
8
WHEREAS, all conditions of the settlement agreement have been performed and met,
9
including, but not limited to, approval of the settlement by this Court and payment of the
10
settlement proceeds;
11
WHEREAS, all conditions of the Court’s November 9, 2017 Order Granting Motion To
12
Approve Settlement Agreement of Minor’s Claim and Apportionment of Settlement Proceeds
13
have been met;
14
THEREFORE the PARTIES to Case No. 3:17-cv-03418-JD, by and through their
15
undersigned counsel of record, respectfully request that the Court issue an order dismissing this
16
matter with prejudice in its entirety. Each party shall bear their own costs and attorneys’ fees.
