PLEASE TAKE NOTICE that, pursuant to Federal Rule of Civil Procedure Section

22 40(a)(1)(A)(ii), Plaintiff Halcyon Syndicate Ltd. LLC (“Plaintiff”) and Defendant Appellation
23 Wine Marketing, Ltd. (“Defendant”) hereby stipulate as follows:

On September 7, 2016 Plaintiff filed the above-captioned lawsuit (this “Action”)

25 in the Superior Court of California in and for the County of San Francisco.

On October 11, 2016, Defendant filed a Notice of Removal of the Action to the

United States District Court, Northern District of California.

On October 17, 2016, Defendant filed an answer to the Complaint.

In June 2017, Plaintiff and Defendant reached a settlement of all claims in this

2 action. On June 12, 2017, a Notice of Conditional Settlement was filed with this Court.
