By order dated March 29, 2017, this Court set the case management conference for June 23,
16
2017, and required personal appearances by lead counsel for all parties. By clerks notice dated May
17
8, 2017, the case management conference was advanced to June 22, 2017. On Thursday, June 22,
18
2017, this Court held the initial case management conference in this matter. Lead counsel Matthew
19
Patrick Noel for J.C. Penney, Inc. (“J.C. Penny”) did not appear.
20
Accordingly, J.C. Penney’s counsel is HEREBY ORDERED TO SHOW CAUSE in writing
21
as to why the Court should not impose monetary sanctions in the amount of $500.00 failure to
22
appear at the case management conference. Counsel’s response to this Order to Show Cause shall
23
be due by June 30, 2017. J.C. Penney is also HEREBY ORDERED TO SHOW CAUSE in writing
24
no later than June 30, 2017, as to why default judgment should not be entered. Failure to respond to
25
this Order shall result in dismissal of this matter without prejudice.
