Plaintiff Adela E. Gomez and defendant Commissioner of Social Security, through their

counsels of record, jointly request to amend the Court’s Scheduling Order in this action as follows.

IT IS STIPULATED, that the untimely filing of plaintiff’s Motion for Summary Judgment
19
(ECF doc. #17) is the result of plaintiff’s counsel’s excusable neglect and, pursuant to Rule 6(b) of
20
the Federal Rules of Civil Procedure, should be accepted for filing in that counsel’s delay has not
21
caused prejudice to defendant or materially impacted these proceedings. It is further stipulated that
22
defendant’s deadline to respond to plaintiff’s Motion for Summary Judgment be extended through
23
December 20, 2017. Based on the delay caused by plaintiff’s counsel, defendant requires additional
24
time to respond to plaintiff’s Motion for Summary Judgment due to conflicting obligations and
25
deadlines in unrelated matters.
