and ‘286 Patents asserted against Apple Inc. by Omni MedSci, Inc.,
2. Apple agrees to dismiss. Without prejudice, all counterclaims for relief pertaining
to the ‘040 and ‘286 Patents against Omni MedSci, Inc. by Apple Inc., and
3. The parties agree that all attorneys’ fees, costs of court and expenses shall be borne
by each party incurring the same.
