(collectively “the Parties”), pursuant to Local Rules 6-1, 6-2, and 7-12, submit this revised 3 stipulation to continue the current trial date and attendant deadlines, subject to the Court’s 4 approval, as follows: 5 6 On May 13, 2020, the Court issued a Scheduling Order, setting this matter for jury trial on July 6, 2021 with the following dates set per the Court’s Scheduling Order: 7 EVENT DATE 8 Amendment of Pleadings July 11, 2020 9 Close of Fact Discovery April 9, 2021 10 Expert Disclosure Deadline February 1, 2021 11 Rebuttal Expert Disclosure Deadline March 1, 2021 12 Close of Expert Discovery March 19, 2021 13 Dispositive Motion Hearing Deadline April 1, 2021 at 2:00 p.m. 14 Pretrial Conference June 28, 2021 at 3:00 p.m. 15 5-Day Jury Trial July 6, 2021 at 8:30 a.m. 16 17 The Parties agree and stipulate that the discovery necessary to prepare this matter for 18 mediation and trial cannot be completed by the above deadlines. The Parties further agree and 19 stipulate that the delay in discovery is due to events beyond the parties’ control and which, 20 despite their best efforts, cannot be rectified. The delays are due to the COVID pandemic and the 21 multi-state locations of the Parties and medical providers.
