The Court having been advised that the parties have agreed to a settlement of this case,

Dkt. No. 28, IT IS HEREBY ORDERED that (1) the putative class claims be dismissed without
15
prejudice; and (2) Plaintiff Bruce Begg’s individual claims be dismissed with prejudice, provided,
16
however, that if any party hereto shall certify to this Court, with proof of service of a copy thereon
17
on opposing counsel, within 60 days from the date hereof, that the agreed consideration for said
18
settlement has not been delivered over, the foregoing Order shall stand vacated and this case shall
19
forthwith be restored to the calendar to be set for trial.
