The parties make this joint 20 request because they are pursuing an administrative resolution that may render further litigation of this 21 case unnecessary. 22 Plaintiffs filed this mandamus action seeking adjudication of their immigrant visa applications by 23 the United States Department of State (“DOS”). DOS agrees to work diligently towards completing 24 adjudication of Plaintiffs’ petitions, absent unforeseen or exceptional circumstances that would require 25 additional time for adjudication. 26 Upon receipt of DOS’ decision, Plaintiffs agree to voluntarily dismiss this case and, in that event, 27 the parties agree to bear their own attorney’s fees and costs. Accordingly, the parties stipulate and 28 Stip to Stay Proceedings C 4:23-cv-00950 DMR 1 1 request that the proceedings in this case be stayed until July 18, 2023, at which time the parties will file 2 a joint status report with the Court. At that time, the parties may request a further continuance of the stay 3 of proceedings, dismissal of the litigation if appropriate, or placement of the case back on the Court’s 4 active docket. A stay of proceedings in this case will benefit the parties and conserve the Court’s 5 resources while the parties pursue a potential administrative resolution.
