SANTA CLARA VALLEY HEALTH AND HOSPITAL SYSTEM, Defendant. 12 13 On or about December 22, 2023, Plaintiff filed a complaint with the Court. ECF No. 1. 14 The Court opened an action pursuant to this filing and, that same day, sent Plaintiff a notice that 15 the action was deficient because he had not paid the filing fee or filed an application for leave to 16 proceed in forma pauperis. ECF No. 2. The Court sent Plaintiff a blank in forma pauperis 17 application form. Id. The deadline has passed, and Plaintiff has not filed an in forma pauperis 18 application. Accordingly, this action is DISMISSED for failure to either pay the filing fee or file a 19 complete in forma pauperis application. The dismissal is without prejudice to Plaintiff filing a 20 motion to reopen the action. Any motion to reopen must be accompanied by either the filing fee 21 or a complete in forma pauperis application. The Clerk shall enter judgment in favor of 22 Defendant and against Plaintiff, terminate all pending motions as moot, and close the case. 23 24 25 26 27 28 IT IS SO ORDERED.
