In v ie w of the clarification and guidance issued by the Department of Justice on October, 19, 2 0 0 9 , the parties believe that a case management conference is in order and that a settlement co n fe ren ce would not be productive at this time. The parties therefore request that this Court c o n v e r t the settlement conference to a case management conference. The parties also request th a t their respective lead counsels be allowed to participate in the case management c o n f ere n c e by telephone, as has been previously allowed.
