On September 17, 2004 the Court heard the motion of plaintiff and counterdefendant Google Inc. and third party defendants Ask Jeeves, Inc. and Earthlink, Inc. to dismiss the counterclaims and third-party claims filed by defendant and counterclaimant American Blind & Wallpaper Factory, Inc. ("American Blind"). Based upon the arguments presented and papers filed by the parties and for good cause shown, IT IS HEREBY ORDERED THAT the motion is GRANTED. American Blind's counterclaims and third-party claims are dismissed, with prejudice. IT IS SO ORDERED.
