Dockets.Justia.com Case 5:05-cv-00037-JW Document 121 Filed 07/09/2007 Page 2 of 5 1 2 7-11; 3 Upon considering Plaintiffs' Motion for Administrative Relief Pursuant to Civil Local Rule IT IS HEREBY ORDERED that the parties shall limit their discovery to class certification 4 issues; preliminary issues such as Defendant's organizational structure and document retention 5 policies; and the production of those documents whose production would impose only a de minimis 6 burden on Plaintiffs or Defendant, such as all documents already produced in European litigation, 7 government investigations involving similar antitrust claims against Defendant, and documents and 8 deposition transcripts produced by Defendant as a third-party litigant in the In re Napster, Inc. 9 Copyright Litigation, No. MDL-00-1369 (MHP) (N.D. Cal.). 10 This discovery limitation shall remain in place only until the next case management 11 conference, to be held after Defendant files and serves its opposition to motion for class certification. 12 At that time, the Court will consider whether the limitation shall be continued, and if so, what 13 additional discovery should take place before Plaintiffs file their reply in support of their motion for 14 class certification.
