This case is scheduled for a Case Management Conference on May 9, 2011. On April 29,

2011, the parties filed a Joint Case Management Statement indicating that Defendant plans to file a
17

petition for certiorari in the Supreme Court.1 Defendant contends that the petition for a writ of

18
certiorari is “not due until June 13, 2011.” (Id. at 2.) Based on the parties’ representations, the
19
Court finds good cause to continue the Conference pending Defendant’s filing of the petition for
20
certiorari.

Accordingly, the Court CONTINUES the Case Management Conference to June 27, 2011 at
22
10 a.m. On or before June 17, 2011, the parties shall submit a Joint Case Management Statement
