HENDRICKSON, and FRANKLIN JAY LOVE, filed their Answer.2 On July 31, 2009, the parties filed cross Motions for Summary Judgment,3 which will be heard on September 4, 2009. In light of the foregoing, and to save Defense counsel the necessity of making multiple trips from Los Angeles to San Jose, Plaintiff respectfully requests that the Case Management Conference currently set for August 14, 2009, at 10:30 a.m. be continued to September 4, 2009, and heard concurrently with the parties' Motions for Summary Judgment.
