WHEREAS Plaintiffs Dongxiao Yue and Netbula, LLC ("Plaintiffs") filed a motion for prejudgment interest through the Court's ECF system on May 19, 2010 (Doc. 482); WHEREAS Plaintiffs intended that the motion be a regularly noticed motion pursuant to Civil Local Rule 7-2, and therefore noticed the hearing date for June 28, 2010, which was more than 35 days after the date the motion was filed; WHEREAS Plaintiffs efiled their motion as a "Motion for Miscellaneous Relief" because there was no category in the ECF system's options for motions for prejudgment interest; WHEREAS the parties agree that Plaintiffs' motion should be treated as a regularly noticed motion pursuant to Civil Local Rule 7-2, including with respect to the briefing schedule and hearing date; NOW THEREFORE, IT IS STIPULATED AND AGREED by and between the parties hereto that Plaintiffs' motion for prejudgment interest shall be treated as a regularly noticed motion pursuant to Civil Local Rule 7-2, that the hearing date shall be on June 28, 2010 (or such July 12, 2010set 9:00 AM. other date as at by the Court), and that opposition and reply papers shall be served and filed as set forth in Civil Local Rule 7-2.
