1 Following a settlement conference with Magistrate Judge Seeborg on April 28, 2008, the

2 Parties, Wine Scout International ("Plaintiff and Counterdefendant") and Garcia Family

3 Vineyards, Inc. ("Defendant and Counterc1aimant") (collectively, the "Parties"), reached a
4 settlement in principle. The Parties subsequently prepared and finalized a settlement agreement

5 and have now each performed their respective obligations pursuant to such settlement agreement.
6 Therefore, notice is hereby given that pursuant to Fed.R.Civ.Pro. 41(a), the Parties
7 voluntarily dismiss the above-captioned action without prejudice.
