WHEREAS, plaintiffs filed the consolidated complaint in this matter on April 24, 2009; WHEREAS, defendant Google, Inc. ("Google") filed an answer to the consolidated complaint on May 18, 2009; WHEREAS, on May 18, 2009, Google also asserted and alleged a counterclaim against one of the consolidated plaintiffs, JIT Packaging, Inc. ("JIT"); WHEREAS, JIT's response to the counterclaim is due to be filed on June 8, 2009; WHEREAS, pursuant to Local Rule 6-1(a), plaintiffs requested defendant Google to agree to a 30 day extension of time for JIT to respond to the counterclaim; WHEREAS, such extension affects no pending court date; WHEREAS, Google has agreed to the 30 day extension requested by plaintiffs to respond to the counterclaim, to July 10, 2009.
