WHEREAS, Defendant International Business Machines Corporation ("IBM") is

 concurrently filing its Motion for Order Continuing Trial Date and Other Deadlines or, in the
 Alternative, for Case Management Conference to Discuss Scheduling Issues (the "Motion");


WHEREAS, Plaintiff RSI Corp. ("RSI") will oppose the Motion;



WHEREAS, IBM has requested that RSI stipulate to shortening the time to hearing for the

 Motion;


WHEREAS, the current schedule in this case sets the fact discovery cut-off for January 18,

 2013; and


WHEREAS, the Parties hereby stipulate pursuant to Local Rule 6-2 to shorten the time to

 hear the Motion so that the Motion can be heard on January 18, 2013;


It is therefore stipulated between the Parties to shorten the time for hearing the Motion and,

 if convenient for the Court's calendar, to set the hearing for January 18, 2013.


