On March 13, 2009, Plaintiff filed a memorandum in which he states "First, please consider this my consent to proceed with the Case, with the same terms and conditions as that of Defense." Although that statement appears to be an attempt to consent to Magistrate Judge jurisdiction, it is not clear and does not include all of the language that is included on the court's model form of Consent to Proceed Before a United States Magistrate Judge. Because the record does not clearly reflect whether or not Plaintiff consents to Magistrate Judge jurisdiction, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 IT IS HEREBY ORDERED that, no later than March 31, 2009, Plaintiff shall file either a "Consent to Proceed Before a United States Magistrate Judge," or else a "Declination to Proceed Before a United States Magistrate Judge and Request for Reassignment." Because it appears that Plaintiff intends to consent, a copy of the consent form is attached hereto for the Plaintiff's use. If Plaintiff does not with to consent to Magistrate Judge jurisdiction, he may obtain a copy of a "Declination to Proceed Before a United States Magistrate Judge and Request for Reassignment" from the clerk of the court, or from the Forms (Civil) section of the court's website at www.cand.uscourts.gov. IT IS FURTHER ORDERED that the hearing on Defendant's motion to dismiss is continued to April 14, 2009 at 10:00 a.m. in Courtroom 5 of this court. Dated: 3/18/09 PATRICIA V.
