Plaintiff has since sought an additional 30 days in which to file and serve the Amended Complaint. Plaintiff's unsigned letter request states that opposing counsel has stipulated to the additional 30 days. On April 24, 2009, the court's staff contacted defense counsel to determine if there was any opposition to plaintiff's request for additional time. Although defendants' counsel indicated that he had not stipulated to the additional time and would oppose the request, he has not yet filed any opposition papers. It is difficult to conceive of grounds sufficient to justify denying plaintiff's request for a brief enlargement of time in which to file an amended complaint. Accordingly, plaintiff's request is GRANTED. Plaintiff shall have until May 25, 2009 in which to file and serve the amended complaint. DATED: 4/28/09 RONALD M.
