4 available Wednesday morning is April 21, 2010; 5 WHEREAS, the Court had issued an order on February 22, 2010, continuing a previously

6 scheduled case management conference to April 23, 2010; 7 WHEREFORE, it is hereby stipulated and agreed, by and between the parties, that the

8 parties will meet before Magistrate Judge James, in Courtroom B, 15th Floor, located at 450 9 Golden Gate Ave., San Francisco, CA 94102, at 10 a.m. on April 21, 2010, for a settlement 10 conference pursuant to the Northern District of California Alternative Dispute Resolution 11 program.

WHEREFORE, it is further stipulated and agreed, by and between the parties, that the
