MOTION TO FILE UNDER SEAL

Plaintiff Elan Microelectronics Corporation (“Elan”) administratively moves to file under
19
seal portions or the entirety of papers in support of its motion to compel Apple, Inc. to produce a
20
testing tool. Having reviewed the papers and considered the arguments of counsel, Elan’s
21
administrative motion to file the above documents under seal is DENIED.

In its June 1, 2011 Order, the court set forth the standards for filing documents under seal,
23
24
including those related to non-dispositive motions.1 The presiding judge in this matter has also
offered guidance on this subject as it relates to dispositive motions.2 The court reiterates that the
25
public’s right to access records in this matter must be respected, and that blanket sealing requests are
26

presumed to contradict that policy. Elan is therefore advised that, before re-filing any further sealing
2
request, it should review the portions or the entirety of the papers in support of its motion to compel
3
that it now seeks to file under seal and apply the standards identified in the court’s previous orders.
