Pursuant to Civil Local Rule 11-4, Douglas E. Lumish hereby respectfully moves

for an Order permitting him to withdraw as counsel for Defendant and Counterclaim Plaintiff

Apple Inc. (“Apple”). In January, 2011, Lumish left the firm of Weil, Gotshal & Manges LLP
4
which is counsel of record for Apple, and which has been Apple’s counsel since the inception of
5
this action. This motion is brought with Apple’s permission after reasonable advance notice, and
6
with no objection from any party or their counsel.
