Lumish hereby respectfully moves 2 for an Order permitting him to withdraw as counsel for Defendant and Counterclaim Plaintiff 3 Apple Inc. (“Apple”). In January, 2011, Lumish left the firm of Weil, Gotshal & Manges LLP 4 which is counsel of record for Apple, and which has been Apple’s counsel since the inception of 5 this action.
