On May 24, 2011 plaintiff Elan Microelectronics Corp. (“Elan”) filed its Motion to

Compel Apple to Supplement its Response to Elan’s Interrogatory No. 13. Dkt. No. 209. On June

3

7, 2011 Apple responded to that Motion indicating that it would provide the requested

4

supplementation. Dkt. No. 273. On June 23, 2011 Apple served its Second Supplemental

5

Response to Elan Microelectronic Corporation’s Interrogatory No. 13. An initial review of that

6

Supplemental Response indicates that Apple has substantially cured the defects raised in Elan’s

7

motion. Therefore, Elan hereby WITHDRAWS its Motion to Compel Apple to Supplement its

8

Response to Elan’s Interrogatory No. 13 without prejudice to Elan seeking additional

9

supplementation should further review of Apple’s response warrant.
